In Kadrey v. Meta, Judge Vince Chhabria grants a second summary judgement for Meta regarding the DMCA complaints. You can't further an act of infringement if there's no infringement to begin with!

If the object and result is fair use, even with books downloaded via BitTorrent, The DMCA doesn't apply.
