How to (learn more) About Your Rights and Retain Them: Don’t Give Them Away!
In this video, we will review the first 10 amendments of the Constitution as well as discuss how they are coherent with what it really means to have rights as a citizen.
Did you know that until the 14th amendment came about, there were no “citizens” of the united States of America only residents? In fact, when we say the United States that describes Washington D.C. and United States Territories.
According to much case law the first Americans and Citizens of the several states or a nation state (such as the Republic of Nevada, or California, or Alabama, etc) are owed the Bill of Rights as they always have been.
"A "US Citizen" upon leaving the District of Columbia becomes involved in "interstate commerce", as a "resident" does not have the common-law right to travel, of a Citizen of one of the several states." Hendrick v. Maryland S.C. Reporter's Rd. 610-625. (1914)
There is no such thing as a citizen of the United States Ex parte Knowles 5 Ca 300, 302 (1855).
1871 The Slaughterhouse Cases (5-4) Butcher’s Union v. Crescent City. City of New Orleans makes new law shutting down all slaughterhouses in New Orleans. The Butcher’s Union sue under the 14th Amendment due process clause.. privileges and immunities under the 14th Amendment, US Citizenship DO NOT include the Bill of Rights, only to citizens of the several States and that U.S. Citizens were clearly distinct from citizens of the several states. The plaintiff’s case rests wholly on the assumption that the citizenship is the same.In other words, the (lowercase u) united States of America is the union of states. The capital U United States is Washington DC and the US Territories and are foreign to the States. The (U) United States had no citizens until the 14th Amendment established them. The foreign United States has its own constitution as each of the states of America do.
The HUGE problem is that most of us still describe ourselves as Citizens of the United States and our God-given unalienable rights are immediately transformed into privledges and immunities. As discussed in the previous video, rights cannot be taken away and privledges can be.
Once we know this and are of clear and sound mind, we may also consider ourselves residents of these several states/or nation state and must not check any boxes that say we are citizens of the United States. Always get a paper copy of these documents and do not check the box, even cross out the question and write in that you are a citizen or resident of the Republic of the State in which you reside.
Did you know that the American Bill of Rights is restatement of certain rights that were presumed to be secured by the people and many opposed this restatement in the Constitution? Thank God those opposed did not suceed!
You see, the Constution spells out in exquiste detail the powers delegated to the government. All other rights and powers are reserved to the people or the states, and the residents or American citizens of those nation states. Remember, the hierachy as it is supposed to be – God, the people, the states and then the federal government.
Those in favor of a Bill of Rights (including Thomas Jefferson and James Madison) argued that it is the nature of government to grow, usurp power and exercise tyranny over the people. The more frequent and evident reminders of the rights of the people, the better!
Most people today have no idea that the intent of the Constitution was and still is to reserve all rights and powers to the people of the states, unless specifically delegated to the federal government.
Backing up the aformentioned statement is the quick review and history of the American Bill of Rights, which constitute the first ten Amendments to the American federal Constitution.
Here are they are, cliff notes style for review –
1. The right to freedom of worship, freedom of speech, a free press, the right to peacefully associate and assemble, and the right to petition the government for redress of grievances.
2. The right to own and carry and travel with weapons without interference.
3. The right to consent if a government wants to quarter troops in oneʻs home.
4. The right to be secure in onʻes person, home, papers and effects against unresaonable searches and seizures. Warrants are only valid with probable cause, signed by oath or affirmation by a sitting judge and particular about place, persons or things to be searched.
5. The right not to be a witness against oneself, not to be tried twice for the same crime, and there can be no capital punishment (death sentances) without calling a grand jury. There can be no deprivation of life, liberty or property without due process of law, nor private property taken for public use without due compensation.
6. The right to a speedy, public trial in the district where the crime was committed, by a jury of oneʻs peers, to be informed of the nature and cause of the accusation, to be confronted with witnessess, and to be able to call witnesses in oneʻs favor, and the right to have the assistance of a lawyer for defense.
7. The right to a trial by jury shall be preserved if the value in controversy exceeds twenty dollars (which today would be the equivalent of at least $1000.00). One may not be tried twice for the same crime which is called double jeopardy.
8. The right to reasonable bail, reasonable fines, and no cruel or unusual punishment such as torture and police brutality.
9. The enumeration of certain rights shall not be construed to deny or disparage others retained by the people.
10. Powers not delagated to the federal government, not prohibited by it to the states, are reserved to the states of the People.
In conclusion, if you were born in one of the several states you have a right to declare your citizenship and you can do that at any time or change it at any time. Just make a public declaration or notification to the representative of the state in which you reside informing that you are a citizen of that state. You can claim citizenship of your own state or claim 14th Amendment citizenship of the United States (Washington D.C and territories). As long as you were born in this country, to parents that are citizens, you have the right to declare or change your citizenship anytime you see fit, no permission or process needed.
