A bill written by Chris Felder to fix broken parts of Florida law that fail families in family court.
Right now, emotional abuse is legally considered child abuse in Florida. But when a parent violates a court-ordered timesharing plan—cutting the other parent out—DCF often won’t investigate. Judges usually won’t act unless there’s physical harm.
Chris Felder’s bill closes that gap with clear legal fixes:

Add “emotional harm from violating a court-ordered parent-child relationship” to the definitions of abuse in Section 39.01(2) and (37)

Update Section 39.301 so DCF must investigate emotional abuse caused by custody violations.

Change vague words in Section 787.03 so police can act when a parent withholds a child “without lawful authority”

Require emergency custody hearings within 3 days when a parenting plan is violated and a child’s safety is at risk

These are simple fixes that will make the law enforceable, protect kids from emotional harm, and stop abusive parents from using custody orders as weapons.
