🚔 If this step doesn’t get done ⚖️, the entire eviction gets thrown out 👀

Today I’m taking a Magistrate Summons for Summary Ejectment to the Sheriff’s Department. This step may seem like just paperwork, but it’s one of the most crucial parts of the eviction process.

Here’s why it matters ⬇️

The defendant (tenant) must be officially served notice of the court date.

If the summons is not properly served, the case will be dismissed—no matter how strong your evidence is.

Serving through the Sheriff ensures the notice is delivered uniformly and legally within the county.

This is the foundation of the case. Without it, there’s no court hearing, no judgment, and no repossession of the property. As property managers, we know that details like this make or break the process.

💡 In North Carolina, the Sheriff’s Office typically requires that summons paperwork be delivered at least 7 days prior to the hearing so they have time to serve the tenant. Missing that deadline can push everything back weeks.

So today it’s simple: get it done, get it served, and get ready for the court case. This is how we protect our landlords’ investments and keep the system moving.
