Hundreds lose water source in Colorado’s poorest county with no notice, no warning

https://coloradosun.com/2025/08/25/costilla-county-water-cutoff/

An unspecified number of people in Costilla County, Colorado, lost their access to a shared water system after county officials voted to declare it a public nuisance and shut it down.

A recent discussion on the news site Hacker News pointed to an unconfirmed article detailing the event.
Factors contributing to the situationAccording to comments on Hacker News, potential causes for the shutdown include:

Political conflict:

Some sources suggest that local authorities are facing public backlash for their heavy-handed response to water issues.

The decision to shut down the water source was made in a 3-2 vote on August 12, 2025, and reportedly was not on the meeting agenda.
Off-grid residents:

The affected population may consist of off-grid residents or individuals with water rights that operate outside of standard municipal or state oversight.

The legality of private water sharing is a point of contention in parts of Colorado.

Water rights and corruption:

Colorado has a long history of complex water rights laws, and the issue is a major political concern.

Speculation suggests that corporate interests may be driving some of the conflict over water access and usage.

Drought conditions:

While there is no direct evidence linking the water shutoff to drought, the Costilla County event occurs amid ongoing drought conditions in Colorado, which further strain water resources and exacerbate conflicts.
Local water context in

Costilla County Costilla County is in Colorado's Division 3 water district, which manages the Upper Rio Grande Basin.

The area relies on both surface and groundwater resources for its municipal, commercial, and agricultural demands.

The region includes communities with alternative water sources and delivery services for
off-grid homes:

Well water:
Access to private wells is subject to strict water rights regulations.

Water delivery services:

Businesses like Sangre de Cristo Water Services and Moreland Mercantile offer water delivery for cisterns.

Public water access:

The San Luis Water Department sells drinking water, and there are free public water collection points in nearby locations.

Colorado's formal rewilding plans

center on the reintroduction of gray wolves and wolverines, a process mandated by voters and legislation, respectively, with the state officially releasing wolves starting in late 2023.

The Colorado Wolf Restoration and Management Plan aims to establish a self-sustaining wolf population while mitigating conflicts with livestock and people.

Separately, legislation passed in 2024 directs the reintroduction of wolverines to the state's high-elevation habitats, a less controversial effort given the species' minimal impact on livestock and humans.

The Plan:

Colorado Parks and Wildlife (CPW) developed the Wolf Restoration and Management Plan,
which includes releasing 10 to 15 wolves annually during the winter for the first three to five years.

Goal:

To achieve a stable, self-sustaining wolf population of at least 50 animals in Colorado.

Management:

Day-to-day management will utilize an impact-based model, with tools including education, authorized killing as a last resort, and livestock compensation programs.

Progress:

10 wolves were released in December 2023, and 15 more were introduced in January 2025.

Wolverine ReintroductionLegislation:

In 2024, Colorado lawmakers passed a bipartisan bill (SB 24-171) to reintroduce the North American wolverine.

Target Habitat:

The plan is to release wolverines into Colorado's high-elevation environments.

Reasoning:

Wolverines are less likely to cause conflict with humans and livestock than wolves, making their reintroduction less controversial.

Broader Rewilding Efforts

Habitat Connectivity:
Initiatives like the proposed Colorado Wildlife Corridor Network aim to enhance connectivity for wildlife across the landscape.

Ecosystem Restoration:

Projects are also underway, such as post-fire restoration in the Upper Poudre Watershed, which includes restoring native vegetation and riparian habitats.

Other Species:

Beyond large predators, discussions and efforts are also focused on other native species, such as fishers and mountain lions, with proposals like the initiative to prohibit their hunting and trapping.

In August 2025, the Fort Garland Water and Sanitation District board in Costilla County, Colorado, voted to stop water sales to rural residents, leaving hundreds without their water source. The vote was 3-2 and went into effect on August 1. The district received $105,000 to upgrade its water systems, though it appears this was not a new grant but rather a payment that was previously received. This has led to frustration among residents who feel the district is prioritizing upgrades over providing essential services to all residents. Background of the issueA broken pump: The district cited a broken pump as the reason for the service cut-off, but residents expressed skepticism, noting that a long-term solution was not being pursued.Grant money: While the district received a grant to upgrade its water systems, it is unclear how the $105,000 was used or why it did not prevent the service cut-off.
County meeting:
A county meeting was held on August 19, 2025, to discuss the issue.
Residents and ranchers spoke at the meeting, and county officials indicated that a long-term solution was being sought.
What happens next?
Continued uncertainty:

As of late August 2025, a long-term solution to the water shortage had not been implemented

Dependence on external aid:

For the time being, affected residents remain dependent on external aid for their water supply.

Ongoing frustration:

Residents remain frustrated with the district's actions, particularly regarding the lack of notice provided before the service was cut off.

Task force established in 2025:

Governor Laura Kelly signed House Bill 2172, establishing a Water Program Task Force.

In April 2025, Kansas Governor Laura Kelly signed House Bill 2172, establishing a bipartisan Water Program Task Force. The bill was officially approved on April 8, 2025, and a ceremonial signing took place in Hays, Kansas, in July 2025.
The key purpose of the new law is to:
Create a long-term water plan: The task force is charged with creating a plan to protect Kansas's water supply.
Establish dedicated funding: The plan will include a dedicated revenue source for the state's water investment program.
Base it on a successful model: The program is designed to be similar to the state's established rolling 10-year transportation programs.
The task force is required to present a report on its findings to the legislature at the beginning of the 2026 legislative session.

The bill's provisions will expire on July 1, 2027.

This task force has three goals: identify risks to the water supply, determine how to approach those risks, and find a way to fund solutions.

Jerry Brown in California signs groundwater legislation

The legislation was opposed by farm groups and Central Valley lawmakers. Critics said the regulations will hurt farmers already strained by sharp reductions in available surface water.

They also objected to the creation of more bureaucracy and raised concerns about property rights.

“It is unfortunate that the governor felt compelled to sign this groundwater management scheme that was hastily cobbled together without regard to historical legal precedent and private property water rights,”

state Sen. Jim Nielsen, R-Gerber, said in a prepared statement.
“Californians who rely on groundwater will now have to deal with not only new and unaccountable government agencies that will police water usage;
they will be at the mercy of these faceless bureaucrats who will impose unknown fees and fines.”

Groundwater makes up about 40 percent of all fresh water consumed in California in average years, and far more in drought years.

Brown said public attention on the drought focused the Legislature on water. He called the drought the “overarching context that allows a lot of action that has taken place in Sacramento.”

NO PRIVATIZATION OF WATER

THIS IS HOW THEY WILL STEAL OUR WATER!!

Privatization.....how does it impact you???

In Pennsylvania our local communities are switching to private run water and sewer companies.

In Northeast Pennsylvania this occurred already and people are outraged. Why?

Rates have already doubled and tripled,
and they received notice that their private services petitioned the PUC for another price hike that piggybacks a rate hike just last year.

Pennsylvania also privatized our turnpike system several years ago....

and people are still upset how much those rates rose and continue to rise.

They say privatization saves money for government but at what expense??

This is just another issue facing Pennsylvanians especially our north central rural residents that needs greater discussion in the General Assembly.

On June 29,2017, the Pennsylvania Public Utility Commission (PUC) approved the application of Aqua
Pennsylvania Wastewater, Inc. (Aqua) to acquire the wastewater system assets of New Garden Township and
New Garden Township Sewer Authority (New Garden). New Garden serves approximately 2,300 customers in
Chester County, Pennsylvania. The PUC approved an addition of up to $29.5 million to Aqua's rate base
pursuant to 66 Pa. C.S. § 1329, which represents the cost to acquire the New Garden assets.

https://whyy.org/articles/pennsylvania-senate-committee-water-privatization-law-hearing-west-whiteland-township-chester-county/

In the July 31 ruling, a three-judge Commonwealth Court panel found the Public Utility Commission erred in allowing Bryn Mawr-based Aqua Pennsylvania to buy a municipal sewer system without showing how the sale would benefit the public.

The judges found that the potential doubling of nearly 3,900 customers’ bills in a suburban Philadelphia township outweighed the possible benefits from digital billing, a 24/7 hotline, and almost $17 million in planned investment for the system.

A Pennsylvania court recently found a state commission should not have approved the sale of a municipal sewer system to a private company because the deal would harm consumers, a ruling that has the potential to raise the bar for such acquisitions.

The decision challenges six years of precedent in favor of water consolidation that critics contend has led to customers overpaying tens of millions of dollars on their bills.

The Public Utility Commission, which approved the deal, said it was still reviewing the ruling. But privatization skeptics say that if the ruling stands it will force the panel to more closely scrutinize proposals.
