“Secret” COVID-19 Pandemic Litigations Trudges On

WASHINGTON (September 17, 2025)—In 2003, in the Bush Administration, Congress had directed its focus, after the Wall in Eastern Europe had fallen down, culminating what had been a Cold War between two superpowers, three decades after the door to China had been opened, and two decades after Beijing had finally capitulated to deposit accession documents to the U.N.’s Biological Weapons Convention. Yet, upon depositing accession documents in New York, Moscow and New York, Chinese emissaries, expressing an air of mutual cooperation with other civilized nations that, despite the aspirations reflected in the accords, there were no enforcement provisions, a detail that perhaps, someday, all peace-loving nations might address. And, in August 2019, the U.S. State Department had reported that China had never acknowledged destruction of the biological munitions it had possessed in 1984, when adopting the BWC.

Almost a decade before the Bush Administration and the Republican controlled Congress had passed an amendment to the Food, Drug & Cosmetics, adding Section 564 to address chemical, biological, radiological and nuclear (CBRN) threats to military forces and citizens, primarily diplomats, residing abroad, some 75,000, DOD had stood up the Armed Forces Medical Intelligence Center (AFMIC), falling under DIA, just a half decade before SARS would emerge, primarily and almost exclusively, like MERS, over a decade later, presenting in discrete outbreaks, with no wider community spread, in nosocomial, or hospital settings, apparently arriving just in time to react to the first epidemic attributed to a bat coronavirus, sharing with SARS-CoV-2 some connection to horseshoe bats circulating in the vicinity not of Wuhan, but over a thousand miles away, in Yunnan, at least coincidentally the location of a military-controlled virology lab. Clearly, this has raised no concerns in Congress nor stirred any curiosity from the ever-watchful eyes of the press. However, in litigztions in state and federal courts in Virginia and DC, these unanswered questions are being raised to high level public officials, who have issued no public statements, and have elected a right to remain silent, especially with midterms around the corner. Clearly, despite a virus attributed to over 1.2 million American deaths, the people have no right to know. Out of sight is out of mind.
