According to an arrest warrant affidavit released by APD, the incident stemmed from an initial fight between two men. The officer involved was attempting to break it up when Acuna-Jacobo "unexpectedly attacked from behind," striking the officer multiple times on the back of the head. The affidavit describes the blows causing "immediate, sharp pain and disorientation," prompting the officer to execute a "controlled takedown maneuver" to subdue him. Acuna-Jacobo was arrested and charged with assault on a peace officer; he was released on bond the following day.

APD Chief Lisa Davis addressed the video in a statement on October 11, acknowledging public concern: "Last night, an Austin police officer struck an individual during a crowd control incident on Sixth Street. After reviewing the video footage, I share the community’s concern and take this matter very seriously. The officer has been removed from patrol and placed on restricted duty pending a thorough investigation."

There are two officers involved in this incident. It is unknown which officer was placed on restricted duty.
