Just Human #349: More Attorneys, Filter Team Filings, And Motions To Dismiss in U.S. v. Comey

In this episode, we unpack some significant and possibly highly consequential filings in United States v. Comey. There are notable additions to Comey’s defense, motions regarding the implementation of a filter team protocol, and two hard-hitting motions to dismiss.

I do my best to go over all of the key points of these developments in the first 30-45 minutes of the show, then spend the rest of the episode going over them in greater detail. I cross-reference the motions against IG reports, media leak memos, Senate transcripts, and other filings in the case. It’s something approximating a line-by-line autopsy of the case.

My big takeaway from it all, at this time anyway, is that the case against Comey seems fatally flawed both in the facts at issue and in its origin. I think it will be dismissed, and it’s possible that Halligan will be disqualified from her office, similar to how Alina Habba was.

I also think that it may be meant to fail. Because it isn’t about “getting Comey.”

I suspect the aim here is to toss a bone to the Complainicans, one, and two, more importantly, to get at some evidence currently shielded by attorney-client privilege and some evidence currently behind classification.

The indictment is a vessel for bringing about legal processes to pierce the attorney-client privilege that covers one set of evidence and to declassify another set.

A legal crowbar.

That’s my working theory at this time.

Half past clever? Maybe. But it fits the filings and indictment better than the government’s own theory.
