Kim Strassel on Subpoenas of GOP Phone Records: Jack Smith Says It Was All Approved, That Doesn’t Make It Any Better

Congress is an independent Branch of government and has protected under the Constitution by the speech and debate clause at a minimum you are supposed to alert the speaker or the head of the Senate to be able to say we are going to be able to do this. Instead we did not find out about this until recent months.”

There is another issue in addition to what you just mentioned that Branch of government the legislative Branch has a duty to provide oversight of executive departments like the Department of Justice for that’s where the former inspector general for the Department of Justice, Michael horwich once said these subpoenas if you have to go that route they have to be done and the most narrowest of circumstances so that you do not chill congresses role of oversight and investigation projects Smith is saying this was all approved and there was a process that does not necessarily make it any better. Chuck Grassley caught onto that he sent a letter back to Smith this week saying it’s great you want to testify but answer a few questions first. Who exactly are you talking to in the Biden Administration about all this and who gave you approval to do this? I think the answer to those questions are going to be very important.”
