Miss Ruth Robinson, a former pencil-factory employee, testified that she had seen Leo M. Frank speak to Mary Phagan about her work, though not very often. Frank would stand close enough to instruct her on inserting rubber tips, demonstrating by picking up a pencil. She heard him call Phagan “Mary.” These incidents occurred last summer (1912).
This testimony was offered to establish Frank’s familiarity with Phagan and his physical proximity while giving work instructions—supporting the State’s suggestion of inappropriate interest—but described routine supervisory behavior in a public setting.
