Countless kids will suffer rape & abuse if we don’t deter the monsters with stiffer sentences! Why won’t the Liberals invoke the Notwithstanding Clause in response to the Supreme Court?

Roman Baber, a Conservative MP, shares a parliamentary clip urging the Liberal government to invoke the Notwithstanding Clause to reinstate mandatory minimum sentences for child pornography offenses, following the Supreme Court’s October 31, 2025, ruling that deemed them unconstitutional under Section 12 of the Charter for being overly broad and potentially cruel.

The ruling in R. v. Senneville and R. v. Naud struck down six-month and one-year minimums for possession and access, respectively, citing cases involving hundreds of exploitative images of young children, yet emphasized that sentences can still be severe based on case specifics.

Public replies reflect widespread frustration with perceived leniency, echoing broader debates on deterrence versus Charter rights, with no immediate Liberal action announced despite calls for legislative response.
