The Sorry State of Medical Freedom in California: How it Got That Way & What We Are Doing About It

California had a soft vaccine mandate for school attendance since the 1960s. A soft mandate allows parents whose children could be harmed by vaccination to opt out with a medical exemption or personal belief exemption, with no interference or oversight. There were no major issues due to communicable infections for more than 50 years.

Starting in 2011, the California legislature began removing parental rights around vaccination, roughly every four years, starting when Governor Jerry Brown signing SB499 into law. With that law, 12 year olds could make medical decisions for sexual health without parental consent -- including for Hepatitis B vaccines and HPV (cervical cancer) vaccines -- under the presumption that children could read package inserts for vaccines, understand them, and make their own decisions. Absurdly, at the same time, Brown signed into law a bill that barred anyone under 18 from using a tanning bed since children couldn't figure out if they would be burned by the tanning bed or not.

Vaccine rights have become increasingly dystopian in California since then, with 3 - 4 bills that incrementally stripped vaccination decisions away from parents, leaving California families with a de facto mandate for 30 vaccines for students to attend school in California.

Most recently, when Californians didn't think vaccination law could get any worse in California, Governor Newsom signed AB144 into law, creating a California-only vaccination schedule and making California into a Public Health Department Vaccine Dictatorship. California is now the only state where the health department now enforces mandates -- stomping the boot of bureaucracy down on every medical exemption submitted -- and sets the vaccine schedule.

It's critical to cement vaccine rights now, before the Digital ID is implemented. During lockdowns, we had a binary social credit score -- you were vaccinated and "free" or unvaccinated and a pariah. If our legal work can end vaccine mandates, we will never again have a binary social credit score around vaccination. We could earn points and have points deducted in a social credit score society, but it will be impossible for it to be binary if mandates are illegal.
