Guernsey is taking a decisive step to strengthen protections against the misuse of artificial intelligence by proposing tougher laws targeting the creation and distribution of non-consensual deepfake pornography.

As AI technology becomes more accessible, the creation of fabricated intimate images — often without the victim’s knowledge — has surged worldwide. Guernsey’s government now aims to modernize its legal framework to ensure that these harmful acts are clearly criminalized and that victims are better protected.

Under the proposed updates to the Sexual Offences Law, the creation of deepfake pornography depicting a real person without their consent will become a specific criminal offense. This includes generating, editing, manipulating, or altering images or videos to falsely portray individuals in sexual or intimate situations. The law would also make it illegal to request, encourage, or knowingly possess such deepfakes. This closes existing legal gaps where current legislation does not fully address AI-generated intimate imagery, leaving victims with limited recourse.

Non-consensual deepfake creation is more than a digital prank — it is a form of image-based sexual abuse that can cause severe psychological, social, and professional harm. Victims often experience humiliation, fear, and long-lasting emotional trauma, especially when fabricated images are shared online or used for blackmail. With AI tools now capable of producing highly realistic content within minutes, the threat has intensified, prompting Guernsey authorities to act swiftly.

In addition to deepfake-specific offenses, the proposed reforms would expand definitions related to intimate image abuse, cyberflashing, and online harassment. This ensures the law keeps pace with rapidly evolving technologies. Law enforcement would also gain stronger powers to investigate and prosecute offenders, even if the content is created or distributed anonymously. Authorities hope these stronger legal tools will deter potential offenders and signal that exploiting AI for sexual harm will not be tolerated.

The legislation also reflects a broader global movement to address digital image abuse. Countries worldwide are revisiting outdated legal frameworks as generative AI blurs the lines between real and fabricated content.
