PEOPLE’S CONSTITUTION ACT 2026 A Bill to irrevocably restore democratic power to Australian citizens – urgently enabling reconnection between governments and people for societal progress.
BE IT ENACTED by the Parliament of the Commonwealth:
Citizens’ Convention (1) Establish “Citizens’ Convention on Democracy and the Constitution” within 90 days. (2) 160 members by stratified civic lottery (as Australian Citizens’ Parliament 2009).
Remit Two-thirds majority recommendations on reforms urgently needed to empower citizens and foster government-people symmetry: (a) Proportional representation for House of Representatives – gives people the power to ensure every vote counts equally, ending single-member distortions and allowing diverse voices to shape the lower house directly for fairer national representation. (b) Enhanced Senate powers or reforms – empowers people to strengthen the elected upper house’s role in federal balance, giving citizens greater check on executive overreach through proportional voting already in place. (c) Citizen-initiated referendums – urgently returns power to the people by letting citizens (with 500,000 signatures) force binding votes on laws/constitution under s.128, bypassing parliamentary gatekeepers for direct input on urgent issues like rights, environment, or federation. (d) Fixed 3-year terms for House, aligned Senate rotations – empowers people to end tactical election timing by PMs, preventing governments from clinging to power and ensuring citizens can demand accountability at predictable intervals. (e) Other reforms for ongoing citizen voice – including Indigenous recognition (post-Voice lessons), bill of rights (citizen-enforceable protections), MP recall (citizens petition to remove underperforming representatives mid-term), mandatory consultations on major policies (giving people input/veto before decisions), and limits on executive prerogatives (e.g., no unchecked PM decisions on treaties/war without citizen approval) – all to reconnect governments with people for collaborative progress.
Binding Duties (1) Table bill for s.128 referendum within 180 days on every 2/3 recommendation – absolute majority vote required, no party whip (Speaker-enforced). (2) Defeated bills trigger automatic referendum at next federal election (integrated with s.128 process). (3) Duties bind successors – no evasion.
