The Case Law:
R v Dytham and the Office of Constable

The duties of constables in Scotland and
across the United Kingdom are governed
by long-standing legal principles that
cannot be overridden by internal policies
or senior officer directives.

The effect of R v Dytham [1979] QB 722.
The Court of Appeal held that a police officer
is personally responsible for performing legal
duties and cannot rely on instructions,
managerial direction, or policy guidance as a
defence for failing to take appropriate action
when required to do so by law.
This ruling applies to all constables in the UK,
including those in Scotland.
