There probably is no better Court of Appeals to have a gun case in than the 5th Circuit. Washington Gun Law President, William Kirk, discusses the matter of United States v. Peterson, a now three times unsuccessful challenge to the NFA's restrictions on suppressors. After first ruling the the Second Amendment is not even implicated by suppressor regulation, the 5th Circuit has now abandoned that ruling but still found the NFA to be completely Constitutional.
