Jack Smith is a former U.S. special counsel who led two federal investigations into former President Donald Trump. Appointed by Attorney General Merrick Garland in November 2022, Smith oversaw probes into Trump’s handling of classified documents and his efforts to overturn the 2020 election results. He was charged with 37 counts in the classified documents case and four counts in the election interference case, both of which were dismissed after Trump won the 2024 election.

On January 22, 2026, Smith testified publicly before the House Judiciary Committee, marking his first public appearance on the matter. In his opening statement, he emphasized that he acted "based on the facts and the law", stating that Trump was charged because the evidence showed he "willfully broke the law — the very laws he took an oath to uphold." Smith defended his decisions as impartial and nonpartisan, asserting he had no political loyalties and that he would prosecute any former president, regardless of party, under the same facts.

Smith’s investigations led to significant legal and political controversy. Trump, upon returning to the White House, has repeatedly attacked Smith, calling him a “criminal” and threatening to prosecute him. In December 2025, the Office of Special Counsel launched an investigation into Smith, alleging his probes were politically motivated. Despite this, Smith’s testimony was widely seen as a defense of the rule of law and professional integrity.
