Immigration proceedings are civil in nature, not criminal, and illegal aliens only have limited due process protections as established by congressional statutes and Supreme Court rulings. U.S. immigration laws explicitly restrict illegal aliens from raising certain arguments in federal courts, forbid judicial review of designated executive actions and confine jurisdiction over specific claims to particular federal courts. When federal courts exercise authority over claims that are barred, unreviewable, or jurisdictionally restricted under these statutes, they contravene federal law. In such instances, the Supreme Court should intervene as needed to reaffirm these boundaries.
