Every year the country waits with bated breath over the latest Supreme Court opinions. If we were living true to the Constitution, this would never happen because the Supreme Court is not supreme when it comes to deciding the constitutionality of a law! Think you disagree? Gun control is one of the most contentious issues in American politics. The pro-Second Amendment, pro-gun arguments are so much more persuasive and based on facts, common sense, and logic that gun control advocates should be embarrassed to even engage in an argument. Successfully arguing this issue really only requires you to repeat the words of gun control advocates back to them with a little commentary. The illogical nature of their arguments and the place of ignorance from which they often argue is quite easy to identify and dismantle for any intellectually honest person.

President Trump recently stirred up a hornets nest when he mentioned that he was considering signing an executive order ending birthright citizenship. As you might expect progressives went crazy, while Democrats and establishment Republicans denounced and/or, in the case of Senator Tim Scott (SC) or outgoing Speaker of the House Paul Ryan, politely “disagreed” with the President. Either way, this provides us with an opportunity to examine the Constitution and, being the constitutional geek that I am, I cannot resist.

As most of you probably remember from your middle school civics' class, the first ten amendments of the United States Constitution are known as the Bill of Rights. What you probably do NOT know is those amendments only apply to the federal government. They were included in the Constitution as a way to insure the states that this newly created federal government would be limited in power. They would not be able to infringe upon the people's freedom of speech or their right to bear arms; they would not be able to quarter their soldiers in our homes, perform unreasonable search and seizures without probable cause, prosecute us without a speedy jury trial or impose excessive fines. But most importantly, the Tenth Amendment specifically states that any powers not granted to the federal government (mostly in Article I, Section 8) is left to the states. Fast-forward a few decades later as the Civil War ended and the slaves were freed. Congress passed and the states ratified the Fourteenth Amendment in order to permanently codify the Civil Rights Act of 1866, which essentially insured that the newly freed slaves were treated equally under the law. It contained a few familiar phrases like, "privileges or immunities", "due process", and "equal protection". Unfortunately for all of us, over the ensuing 150 years the Supreme Court, as it is apt to do, has perverted the Constitution (rather than protect and defend it) and found ways to apply the Bill of Rights to the states. The call for the elimination of the Electoral College by liberals, progressives and Democrats continues to swell. After all, they rationalize, Bush got less votes than Gore and Trump got less votes than Clinton so why should they be President? Fortunately for the rest of America, the Founding Fathers had enough foresight to include the Electoral College process in the Constitution to protect the country as a whole from the tyranny of the majority. In this episode, I give a brief history lesson on the Electoral College and explain why the, now underway, National Popular Vote movement, with the goal of eliminating the Electoral College, is both dangerous to the country and, of course, unconstitutional.

The Federalist Papers were written and published in New York newspapers in 1787-1788 in order to sway public opinion to approve and ratify the newly devised United States Constitution. The essays were written by three prominent members of the founding generation - Alexander Hamilton, James Madison, and John Jay. I consider these essays the user’s guide for the Constitution and, therefore, deserve at least a perfunctory understanding. Short of reading the debates from the constitutional convention and the state ratification debates, the Federalist Papers provide some of the best insights into the United States Constitution. In this episode, we will cover 25-26 essays - those covering the topics of the weaknesses of the Articles of Confederation, the arguments for a stronger centralized government and the system of checks and balances devised by the Constitution. I came across an article about a lawsuit brought by the Freedom From Religion Foundation against an Ohio middle school over their display of the Ten Commandments, a gift from the Class of 1926. As I read through the FFRF's press release, I grew more and more confused and irritated. Among other things, they applauded "the district for taking action to remedy this violation." That word, "violation" struck my curiosity but it only took two sentences later to find out what they were referring to - the Supreme Court's propensity to find religious displays, such as the Ten Commandments, unconstitutional as violations of the Establishment Clause of the First Amendment. This sent me on a quest for the truth about this anti-intuitive idea of freedom "from" religion.

Following the two most recent mass shootings, the usual cries of DO SOMETHING have resurfaced as they always do following attacks or a crisis. After the Las Vegas shooting, we heard cries for a ban on bump stocks; today it's calls for red flag legislation. These laws, also known as Gun-Violence Restraining Orders, or Extreme Risk Protection Orders allow family members and mental health professionals to petition a court for an order enabling legal authorities to temporarily remove guns from those who are deemed to be a significant danger to themselves or others. As is often the case with these DO SOMETHING solutions, it sounds good on the surface but what is the truth? Listen to find out.

Impeachment is a constitutional tool whose responsibility is granted solely to the House of Representatives. As outlined in the Constitution, the rules of impeachment are both specific (treason and bribery) and general (high crimes and misdemeanors). Besides the president and vice president, all "civil officers" are subject to impeachment. That means all federal employees whether appointed or hired. Contrary to popular belief, impeachment does not mean removal from office. It is essentially an indictment. The Constitution grants the Senate the responsibility of holding a trial based on the evidence presented by the House. If convicted, the defendant can be removed from office and banned from future service in the federal government. The power of impeachment has been used sparingly with only 19 instances in the nation's history. You may be surprised by what we uncover when we dive into the language from the Constitution about impeachment, read the words of the Founding Fathers on the topic and study the history of its practice. Following the killing of Iranian General Qasem Soleimani (as discussed in the previous Episode #81), national Democrats insisted that Trump violated the War Powers Act of 1973 and passed a non-binding resolution in the House condemning the strike. In that episode I spent a lot of time examining America’s penchant for perpetual war. As discussed, the list of American intervention overseas is quite remarkable: Hawaii, Cuba, Puerto Rico, Nicaragua, Honduras, Guatemala, Grenada, Panama, Yugoslavia, the Korean Peninsula, the Philippines, Vietnam, Chile, Egypt, Kosovo, Somalia, Congo, currently we are involved in Iraq, Afghanistan, Syria and Yemen. In this episode, I want to turn our attention away from WHERE the U.S. military has been (or are currently) to focus on the HOW. How is the United States war-making capabilities supposed to be carried out or applied? You may be surprised (or not) to know that the Constitution's dictates around the involvement of our military has largely been ignored for the last 78 years.

They want statehood for Puerto Rico and Washington, D.C. and open borders, amnesty, voting and welfare rights for immigrants - all of which equate to more power transferred to the national Democrats.

In this episode we examine the American experiment through the lens of the Tenth Amendment which Thomas Jefferson called the foundation of the Constitution. The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. That means, the federal government is only authorized to do those few things that have been delegated to it. It is my contention that, if the federal government was still in its tiny, little sandbox created for it by the Constitution, this country would thrive. Unfortunately the federal leviathan has not only outgrown its sandbox but has taken over the entire yard, neighborhood, state, country! The consequences of the overreach are largely unseen yet substantial. The corruption, the failure of one-size-fits-all policies, the influence peddling - all of it acts as a restraint on the American system of free markets, entrepreneurism, freedom and liberty. Instead we allow a handful of powerful people in D.C. and the media to divide us into a series of special interest groups who fight and bicker with each other. The Constitution served as the glue that held the United States together for over two hundred years. Unfortunately, over the last century, we have seen a steady erosion of the principles and rules of the game captured in that document. So much so that we now live in a post-constitutional country where the document is all but ignored or it is bastardized to fit the needs of the ruling class. The sheer size of the federal government and the power it wields far exceeds anything the founding generation could ever have imagined. For those who love the country, this is a sad revelation. For those who love power, control and influence, they can claim victory.

Resident Biden gave a brief address in the Rose Garden in early April, 2021 regarding his Executive Orders on gun control. In that short address, he made at least six clearly false statements or outright lies. In this episode we focus our attention on one particularly misleading statement about gun show loopholes and use it as a lesson to demonstrate how the Left manipulates their voters and the media through the use of language. It's the perfect storm! A voter base uninterested in the truth; just searching for bias confirmation. A political party willing to lie and mislead. And a media willing to parrot the narrative. Open borders; pushing to grant amnesty and voting rights to illegal immigrants. Colluding with big tech to censor dissent. Try to nationalize elections and make vote fraud legal. During a recent press briefing, the White House press secretary said this with a straight face: “Federal law overrides state law.” In this brief episode I put to rest (once and for all) the lie that federal law has supremacy over state law.

What powers are granted by the United States Constitution to the federal government? Not much! What is NOT in the Constitution? A lot! Despite what members of the doomsday cult formerly known as the Democratic Party say and despite what members of the alphabet soup, conspiracy media say, the Second Amendment is absolutely absolute! If the Second Amendment did not exist, Americans would still have the natural right to keep and bear arms. No government has the right to infringe on a natural right. Unlike most other countries, in the United States, we are fortunate enough to have that fact enshrined in our nation’s founding document.
