Rights are created by contract.

When the UN sets out 'human-rights' these come into existence by contract. So you have contracted with your society/government to submit to their laws and they have contracted in those laws to give you certain rights. Your society/government has then contracted with the UN to submit to their laws in return for certain rights as a nation. So rights do exist by agreement/contract/consent.
