Per Black's Law Dictionary, 9th ed, 2009:
malice aforethought. (l7c) The requisite mental state for common-law murder, encompassing anyone of the following: (1) the intent to kill, (2) the intent to inflict grievous bodily harm, (3) extremely reckless indifference to the value of human life (the so-called "abandoned and malignant heart"), or (4) the intent to commit a dangerous felony (which leads to culpability under the felony-murder rule).

The Vaccine Protection Act of 1986 won't protect these people, due to their "malice aforethought".

Take note that Bill Gates was originally killed in 2015 by a mob in India that was incensed due to his vaccines that were killing people. Several clones / doubles have been standing in his stead since. I suppose Gates' clones / doubles deserve to be tried as much as Gates himself.

Melinda Gates is currently under arrest at GITMO. Dr Fuellmich may well leave her case to the JAG at GITMO.
