Should Congress take Over Presidential Elections?
Senators Angus King, Amy Klobuchar, and Dick Durbin have released a discussion draft of their legislation to place Congress in control of the Presidential election process, in direct violation of the Constitution of the United States.
The Discussion Draft of the Electoral Count Modernization Act: To amend title 3, United States Code, to revise the rules for Presidential elections and counting electoral votes, and for other purposes.
This legislation claims the power to revise the rules for two things: Presidential elections and counting electoral votes. The first question we must ask is, does the Constitution delegate to Congress the power to regulate Presidential elections?
