We'll discuss what happens if prior to a real estate closing, the property experiences damage that wasn't previously there as of the contract signing date.

Typically, sellers are expected to maintain their property in the same condition as seen on the contract signing date, and can be responsible for any damage that occurs prior to closing depending on the terms of the contract.

In Florida and other states where a standard Realtor contract is used, the seller is expected to maintain the property in the same condition as documented on the Effective Date, which is the date when the contract was fully executed and signed by all parties.

Keep in mind that all of this depends on there being documentation of the property condition on and around the Effective Date. If the buyer didn't bother to document (i.e. take photos, videos) the condition, then it'll be hard to prove that the damage wasn't previously there.

This is an important concept to understand as it can happen, especially when the seller is moving out a lot of furniture. Sometimes the movers won't be careful and will cause scuffs and damage to the walls or floors etc.
